Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Leviathan Analytics platform, website, and related services (the “Service”) provided by Leviathan Analytics, Inc. (“Leviathan,” “we,” “us”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Leviathan is a strategic intelligence platform that connects to your organizational data sources and provides automated analytics, KPI discovery, executive briefings, trend analysis, and anomaly detection. The Service is designed for use by senior leadership and their teams within organizations.

To use the Service, you must create an account using Google OAuth. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use.

You represent that the information you provide is accurate and that you are authorized to create an account on behalf of your organization, if applicable.

Your organization's data is stored within isolated workspaces. You retain all rights to your data. By using the Service, you grant Leviathan a limited, non-exclusive license to process your data solely for the purpose of providing the Service.

You are responsible for ensuring that you have the necessary rights and permissions to upload and process data through the Service, and that your use complies with all applicable laws and regulations.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to the Service or other users' data
• Interfere with or disrupt the integrity or performance of the Service
• Reverse-engineer, decompile, or disassemble any part of the Service
• Use the Service to store or transmit malicious code
• Resell, sublicense, or redistribute the Service without written authorization

The Service, including its design, features, algorithms, documentation, and all related intellectual property, is owned by Leviathan Analytics, Inc. and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or brand features.

The Service uses artificial intelligence to generate analytics, briefs, and reports. While we strive for accuracy, AI-generated content is provided for informational purposes and should not be the sole basis for critical business decisions. You are responsible for reviewing and validating any outputs before acting on them.

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable advance notice. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

Certain features of the Service may require a paid subscription. Fees, billing cycles, and payment terms will be communicated at the time of purchase. All fees are non-refundable unless otherwise stated or required by law.

To the maximum extent permitted by law, Leviathan shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claims arising under these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless Leviathan, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

Either party may terminate the account at any time. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Service ceases immediately. We will make your data available for export for 30 days following termination.

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms and updating the effective date. Continued use of the Service after changes constitutes acceptance.
